The GatherNest name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GatherNest LLC. You may not use these marks without our prior written permission.
You may not copy, modify, distribute, sell, or lease any part of our service or software, nor may you reverse engineer or attempt to extract the source code.
GatherNest integrates with third-party services including Google, Apple, and Stripe. Your use of these services is subject to their respective terms of service and privacy policies:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the service will meet your specific requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GATHERNEST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
In no event shall our total liability exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.
You agree to defend, indemnify, and hold harmless GatherNest LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your User Content.
You may terminate your account at any time by deleting your account through the account settings or by contacting us at support@gathernest.io.
We may suspend or terminate your account and access to the service at any time, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the service will immediately cease. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the federal and state courts for the resolution of any disputes.

For any dispute that cannot be resolved informally, you agree that the dispute will be resolved by binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we may also notify you via email or in-app notification. Your continued use of GatherNest after any changes indicates your acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GatherNest LLC regarding the use of the service and supersede any prior agreements or understandings.
